MIIT to Draft Wireless Spectrum Regulation

China's Ministry of Industry and Information Technology (MIIT) is currently conducting research preliminary to laws regulating the wireless spectrum. China's wireless spectrum resource allocation and usage had previously been determined and granted on the basis of administrative review, and wireless spectrum resources are generally granted at no cost or extremely low cost.
An industry insider who requested anonymity said that while some spectrum bands had been claimed for use by companies or government divisions, they had long since been abandoned or ignored, while new technology developments and growth in subscriber volumes have resulted in other spectrum bands being too severely overloaded to sufficiently support further growth. The problems are the result of a number of factors and regulatory agencies, and are unlikely to be wholly resolved simply through new management regulations. Regulations are approved and enforced by China's State Council, while new legislation must be discussed and ratified by the National People's Congress (NPC), after which it gains the full force of law.
The Regulations of the People's Republic of China on the Management of Radio Operation currently in effect were announced by the State Council and the Central Military Commission in 1993, nearly 20 years ago.
