MIIT to Release New Internet Security Regulations

China's Ministry of Industry and Information Technology (MIIT) announced today that it will release a draft of its "Management Regulations for the Security and Oversight of Communications Networks," and will incorporate feedback that it receives before September 4 prior to a subsequent official release and promulgation of the final regulations.
Under the MIIT's new regulations, all public communications and internet networks managed by domestic telecom service operators and internet domain name service providers must meet communications network security standards. At the same time, communications network operators will be required to divide communications networks already in operation into discrete units, and then rate them, according to their importance to national and societal economic development, on a scale of one to five.
MIIT will appoint communications management organizations at the provincial, regional, or municipal levels to guide, oversee, coordinate, and inspect the work of regional communications network security in accordance with the regulations. MIIT will also shortly promulgate penalties for violators of the new regulations. Unregistered operators of communications or internet networks, or operators of networks containing security flaws, will initially receive a warning, and may be fined up to RMB 30,000.
