Changyou Sues Kylin for IPR Infringement
Sina Tech, 7/08/09
Changyou, the online gaming subsidiary of Chinese internet portal Sohu (Nasdaq: SOHU), has filed suit against Beijing-based online gaming developer and operator Kylin. Changyou alleges it has concrete evidence that Kylin's self-developed flagship, history-themed MMORPG Chinggis Khan (Genghis Khan) contains infringing code taken from Changyou's martial arts-themed MMORPG Tian Long Ba Bu. Moreover, Changyou points out that Kylin CEO Shang Jin participated in the development of Tian Long Ba Bu and could have stolen the code. The case will be heard by Beijing Haidian District People's Court.
Changyou has requested the court order Kylin to immediately suspend operation of Chinggis Khan, including distribution of the game's client software, place statements of public apology on both the title page of the official Chinggis Khan website (http://han.70yx.com/) and newspaper Legal Daily for a full month, and pay RMB 1. However, Changyou reserves the right to seek further damages for infringement.
Editor's Note: In early June, it was rumored that Sohu's game portal 17173 had been told by Sohu CEO Charles Zhang to omit any reference to Kylin's MMORPG Chinggis Khan (Genghis Khan). For more background on this topic, please see "Rumor: Sohu Bars Kylin MMORPG from Ranking" MD 6/11/09 issue.
