Kaixin001 Sues Kaixin

Social networking service (SNS) Kaixin001 has formally brought an unfair competition suit against Kaixin, a rival SNS owned by Internet platform provider Oak Pacific Interactive, in the Beijing No.2 Intermediate People's Court. Kaixin001 is demanding that Oak Pacific cease using a similar name for its SNS offering, and that it issue a formal public apology.
A spokesperson for Kaixin001 confirmed the lawsuit, but said the company would not comment on the suit for the time being.
In its filing, Kaixin001 said that the name, web address, functionality, target demographic and content of Kaixin was extremely similar to Kaixin001. In addition, the suit noted the extremely close similarity in homepage design between the two companies – proof, it alleges, of unfair competition.
A previous report said that Oak Pacific's attempt to acquire Kaixin001 in September 2008 had proven fruitless. In October 2008, Oak Pacific purchased the domain name Kaixin.com and began operating its own similar site.
