China Considers Harsher Punishment for Hackers

A criminal law amendment has been introduced to China's legislative bodies seeking harsher punishments for hacking of computers and information systems, including the illegal obtainment of computer data. The new legislation calls for punishments of 3 years or less in prison as well as monetary penalties for crimes of a serious nature, and punishments of 3 to 7 years in prison as well as monetary penalties for crimes of an extremely serious nature.

In addition, the new legislation suggests Internet users that suffer damages stemming from illegal network intrusions have the right to issue a take-down notice to service providers. If service providers fail to respond to the request within a reasonable period of time, they will risk joint liability for further damages resulting from the offending content.
