China Issues Draft E-commerce Counterfeit, Online IPR Infringement Rules

The General Office of China's State Council recently issued a draft plan to crack down on counterfeit e-commerce products and internet copyright infringement and to accelerate the development of related laws and regulations.
The draft plan states that it will take actions to crack down on counterfeit e-commerce products, such as agricultural materials, food, medicine, cosmetics, medical devices, electrical appliances, electronics, auto parts, decorative materials, chemicals, children's products, clothing, shoes, and hats by strengthening the enforcement of laws and regulations.
In addition, it plans to tackle the counterfeiting of well-known trademarks and foreign brands to protect the interests of copyright holders and customers.
The draft plan also states that it will monitor internet literature, music, movies and TV shows, animation, software, and other copyrighted products in order to investigate illegal reproductions and other online copyright infringing actions in a timely manner.
According to the draft plan, it will expand the range of its copyright monitoring activities, relying on the national copyright monitoring platform to track app stores, cloud storage, Chinese microblogging platform Weibo (Nasdaq: WB), Tencent's (0700.HK) WeChat mobile messaging app, and other relatively recently emerging communications and distribution platforms.
